. The dispatch of the ordered land register excerpt takes place in principle by post. A written power of attorney is indispensable and is within the scope of performance of the customer. DeinGrundbuch.de reserves the right to unilaterally withdraw from the order. If an electronic land register retrieval is available, you will receive the land register extract usually within 24h, in all other cases usually within 1 week, from receipt of your power of attorney by us. In case of high processing status of the land registry offices, the processing time may take longer. A binding delivery time of the ordered products is not agreed. Dein-Grundbuch.de is exclusively commissioned by the customer to request the products. The amount for the service is due by delivery of the invoice. The contracting parties agree that the invoice will be provided to the customer exclusively digitally in the file format PDF. Sending the invoice in paper form by mail is subject to an additional charge. The fees of the cost invoice of the competent district court as well as of the competent land registry office for the respective products are paid by the customer exclusively (idR. ten Euro per uncertified land register extract/ the cost invoice of the land registry offices is variable). Please note that the costs for the service are also due if incorrect or missing information e.g. on sheet no., address or owner has been provided and therefore no product can be provided. For the immediate processing, as well as for the coordination with the responsible authority, we need a power of attorney. You will find the pre-filled template in your customer portal. Insofar as no response is received within the next two days or the order is submitted with missing evidence of legitimate interest pursuant to Section 12 GBO, the order will be processed with the available data and attachments. In case of queries, the responsible office will then contact you directly. Questions regarding the processing status should then be addressed directly to the competent authority. We refer in particular to the scope of the land register regulations. If the service and product is requested exclusively by email, a service fee of five euros plus the costs of the respective product by the offices will be charged in addition to the purchase price. This delivery request is not a standard service and can be ordered additionally by the customer. Telephone support is not included in the services. The contracting parties agree that communication will be by e-mail.

Right of withdrawal:

The order is usually processed immediately, after the start of processing a revocation is no longer possible. The customer agrees and expressly requires that before the end of the revocation period with the execution of the ordered service is started. I am aware that I lose my right of withdrawal when the contract is completely fulfilled by you. Otherwise, you have the right to revoke this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform us (ImmoWert Experts GmbH, Clara-Zetkin-Str. 10A, 01796 Pirna, Fax: 03501 / 599 344 8, e-mail: storno@deingrundbuch.de) by means of a clear statement (eg a letter sent by mail, fax or e-mail) about your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory. To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period. The right of revocation shall expire upon complete fulfillment of the contract. Consequences of the revocation If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. The right of withdrawal expires if the provider has fully performed the service and has only started to perform the service after the customer has given his express consent to this and at the same time confirmed his knowledge that he loses his right of withdrawal upon full performance of the contract by the provider. If you have requested that the services begin during the revocation period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of revocation with regard to this contract compared to the total scope of the services provided for in the contract. The flat-rate expense allowance in the event of premature and unilateral termination of the contract by the customer shall be nine euros gross. The cancellation shall be sent by e-mail or fax.

The General Terms and Conditions are subject to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods, even if orders are placed from abroad. If a provision of these terms and conditions is invalid, the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by a provision that comes closest to the meaning and purpose of the ineffective provision in a legally effective manner. The same applies to any loopholes.
